Guru to the Gurus: David Maister

Nearly three decades ago, in the early days of Edge International, there was only one writer in the area of managing a professional firm that commanded our unqualified respect and attention. That was David Maister.

“Managing the Professional Services Firm” is the Bible, according to many leaders of some of the largest professional service firms in the world. “True Professionals” spoke to the firms for whom dignity and quality service were the engines of success. And he wrote so much more in collaborations and articles.


In Edge, we were lucky enough to find ourselves presenting at a few conferences in common with David, in various places around the world and one day ended up having a very private informal retreat. This led to the creation of PracticeCoach®, an extraordinarily comprehensive video-based resource to help law firm leaders around the world. It stars David.  What a joy it was to create with him.

His philosophy was so in harmony with ours.  For example, we loved his guarantee of satisfaction (and were proud that we offered one as well even before we knew he did).

There were some very cool things I learned from David:

  • David loves his wife, Kathy, with such passion and always treats her as his trusted advisor and coach. (She's the Guru's Guru.) With Kathy, David taught my wife, Bethany, and me how to travel for weeks internationally without checking luggage. “IMPOSSIBLE!” we said standing on the curb in front of their place one morning with four huge suitcases’s while David and Kathy had their little rollers behind them. “You just need to learn how to pack properly…” they replied, and during our next visit we got the tutorial. (Actually, David and Kathy, if you wrote a book based on that tutorial….) Bethany and I owe David and Kathy the moon for that advice.
  • David exemplifies passion. He loves his wife and his music collection which is of a magnitude that makes it the 8th wonder of the world…and he’ll sing till dawn. :-)
  • David has energized audience after audience…forcing thought about important issues and even more importantly, sometimes with the help of voting machines, making them actually decide on things.

I am not surprised by the awards and accolades* he has received… just delighted.

The good news is that this is not a eulogy (even if it sounds like one). David and Kathy’s infectious smiles will remain available to us for many many happy years to come.

If there is a sad note in this homage, it is that David's retirement represents a loss to my beloved legal profession and all the other professions he served so well.  However, his books and programs live on. As I write this, I am helping a prominent South American firm to use the study in his book, “Practice What You Preach,” to help them analyze and choose the most fruitful areas of focus for their continued improvement.

Maybe David’s and Kathy's retirements will be like some famous souls who preceded them who were coaxed back into the game for an important gig or two.

By the way, Kathy retired from one of the most incredible video enhanced blogs in history: startcooking.com where you can still experience valuable lessons - check it out !  This is not an amateur undertaking - you will find broadcast-quality production values.


David and Kathy, Bethany and I treasure you and I know if we gathered those of like mind we’d need a mighty big arena.

Retire in good health!! Well earned - BRAVO!

I was practicing law in Edmonton during the Oiler dynasty and saw Gretzky informally as well as on the ice.   He was a young man of values and integrity… a great contributor to the community… and always selfless… ego-less… always doing his best… and his best, we all know in hindsight, was truly awesome.

To my regular readers, apologies for this digression from the management of law firms... but I was so tempted to express a political view and managed to suppress it in favour of simply encouraging participation.  There... it's off my chest!  Thank you for permitting this indulgence.

American and Canadian Lawyers - IMPORTANT & TIME SENSITIVE


The most important thing you can do for our profession today is to visit the ABA or CBA and sign your respective petition to assist lawyers in Pakistan. 

I have never asked before but how about forwarding this to every lawyer in your firm.

PUNCHLINE:  I am truly honoured by finding myself in the top 100 - make no mistake about that.  But why would I seek votes - there are many great blogs out there including ones that are not in the top 100 (and some that are in the top 100 are way too commercial for my taste - where the bloggers sell sell sell).  So I don't seek your vote - but do appreciate your dropping by or subscribing by email or even better by RSS feed.  I would like to think, my reader, that you and I have something in common.  We enjoy different points of view and variety.  I think some of my posts have been stronger than others - some more interesting than others.  So please keep visiting Amazing Firms Amazing Practices but continually look around and find other blogs that appeal to you and scan for a useful post now and then.  I trust you to do that by yourself without the blessing of any third party - I don't even think the winner of a popularity contest deserves your patronage more than a blog that might be more obscure but have data or a point of view you are interested in.

I think this is my least interesting blog to date but I felt compelled to write it so thanks for reading - and a reminder - don't vote for me (if you click the "vote for this blog" link above it will take you to a place worth contemplating for a few seconds before you return to the fires that burn on your desk.)


Some Lawyers Get Perks for Health and Happiness


The New York Times Business section included an article yesterday called:  For Lawyers, Perks to Fit a Lifestyle.

The article alluded to a variety of perks including money, candied apples, milkshakes, car discounts, valet services, wine, office parties, in-office gourmet meals on silver platters, nap rooms, child care, emergency nanny services, sabbaticals and even an occasional masseuse.

Perhaps this was the most important perk mentioned:

Fried, Frank, Harris, Shriver & Jacobson, a 600-lawyer firm based in New York, offers employees a service akin to a personal issues coach and psychotherapist through a deal with Corporate Counseling Associates of Manhattan. The consulting firm has a battery of staff psychologists and social workers to provide advice on issues including stress, anxiety, depression and divorce.

While many companies have offered employee assistance programs over the years, few have Ph.D. psychologists on staff.

A spokeswoman for Fried, Frank, Paula Zirinsky, said, “We want employees to be successful in their personal as well as their work lives.”

PUNCHLINE:  Some of my law-firm clients have very serious challenges dealing with individuals for whom "psychological intervention" should be mandatory.  In these severe cases, ostensibly productive members of the firm are causing harm to client relationships and firm personnel with long term costs that are hugely underestimated by their firms.  Perhaps offering such perks is a way to make it just a little easier to address these firm-threatening challenges.
Read the entire article...  perhaps your firm can offer many of the perks mentioned - most are not that expensive and I'll bet the return on investment would be healthy indeed (pun intended).

Chief Justice Iftikhar Mohammed Chaudhry -- fired by Musharraf Saturday -- in a phone call to a gathering of lawyers urged them to go to "every corner of Pakistan and give the message that this is the time to sacrifice."

My view:  When lawyers stand up to a dictator who suspends the rule of law, then it is the finest imaginable "judicial activism".  If Musharraf's actions are tolerated, say goodbye to liberty.

Police Use Tear Gas and Batons against Lawyers!


Pakistan attacks the rule of law and beats on lawyers who were attempting to peacefully protest for the most fundamental rights available to human beings.  Every lawyer in the world feels the pain of every brutal blow of the oppressing regime's batons on our profession.  This is not a political blog but it is about the legal profession and there is no more important issue than the role lawyers play in maintaining the rule of law.  This is a devastating day for every lawyer.

The sophistication of the analysis of the flight of bats is unprecedented and its rather poetic that a visualization should bring top prize.

Want competitive advantage? Use proper names!



If you want existing clients to like you as much as possible and even more so prospective clients then use proper names in conversation.  Now there's PROOF if you need it.  

Most probable reasons you may not be using proper names in conversations:
  • You are not completely certain you remember (or pronounce) the name right so why risk it
  • There is a group and you can’t remember all their names so feel you shouldn't use any
  • You are afraid of sounding patronizing
  • It’s a discipline you simply have not mastered.
PROOF:  A new study by Dr. Amit Almor of the University of South Carolina used MRI brain scans to show the different responses when a subject hears a proper name or a pronoun referring to a previously named person. 

“The brain lit up with activity when proper names were used, including areas that are not associated with language,” Almor said. “We saw considerable activity in areas of the parietal lobe that involve spatial processing that was absent when pronouns were used.”

How:
  • Write the names down (if a group – make a seating chart – at least first names)
  • If hard to pronounce, ask and practice (they will love you for it)
  • Practice using the names (starting right now)
PUNCHLINE:  Perhaps in a perfect world you would simply be appreciated for the skilled genius you are.  I don’t disagree.  However, if competitive advantage is important to you in this imperfect world, put this post into action.  (Thinking about it, alone, will yield nothing.)

In Memory of the Billable Hour

“Ford & Harrison, a 190-attorney labor and employment firm, has tossed out billable-hour requirements for first-year associates. The program aims to close the practical-skills gap of law school education and increase value to clients. The firm also hopes it will enable associates to handle meatier matters more quickly.“ according to Leigh Jones of The National Law Journal.

I have the privilege of knowing C. Lash Harrison (pictured) and his remarkable stature within his firm.  When I read about this bold initiative I was in no way surprised that it was Lash who had the gravitas to pull this off.  It may be prophetic that the tag line on the Ford & Harrison firm’s website reads:  “THE RIGHT RESPONSE AT THE RIGHT TIME”

"Everyone sits around and complains about the problems," said C. Lash Harrison, managing partner of the law firm. "I figured, what the heck, maybe we can try something."

Observation:  The issue of newer lawyers recording time on files is a bit of a hornet’s nest in most firms.  If the time is billable, it detracts from the billing partner’s realization rate and perhaps even hours billed.   Carefully measured associates steer away from files where they can’t record billable time.  This creates a tension that is based on economic reality but serves neither the associate’s training objectives nor the client’s desire to optimize value.  Thank goodness for fresh thinking and bold initiatives.  That makes C. Lash Harrison a hero to me.

My friend Patrick Lamb joined me and my daughter, Raquel, for dinner last night in Chicago.  I do not typically post about personal or family matters but I would be remiss if  I did not acknowledge with gratitude Pat’s support for Raquel’s career as evidenced by his post Vote Riskin. "But I cannot join you in your proposal that the bar disciplinary committee investigate Mr. Stimson for conduct 'prejudicial to the administration of justice.' "

PUNCHLINE: 
It is refreshing to see that lawyers like Mr. Dershowitz place the law even above the temptation to right a wrong.  Read the entire (concise) letter.

NYT: Apology Not Accepted

Apparently: "It is hard to render a convincing apology when you are not really apologizing."

FASTFORWARD:  If you are wondering why I am tracking this on Amazing Firms Amazing Practices it is because this is what I love about my profession and the great individuals and firms that practice in it - they see that even though the practice of law has become more business-like, it is still a profession and the great lawyers care a lot more about that than they do about the money.  Those lawyers and firms are truly heroes and well under-appreciated.

Official Attacks Top Law Firms

The lion on the left is a metaphor for the lawyers and law firms who stand up to attacks against our profession and justice itself.

In a New York Times article today, Official Attacks Top Law Firms Over Detainees,  you will see that there is an insidious movement to have business clients fire those preeminent corporate law firms who dare to use some of their pro bono time to defend the very foundation of the rule of law, like the Doctrine of Habeas Corpus

The "senior Pentagon official" is apparently not alone - the article references a journalist using the Freedom of Information Act for what looks like, smells like and just might be a McCarthy-esque attack on prominent law firms.

Those responsible for this vicious attack would not know "Magna Carta" if they stepped on it (and they are stepping on it)  – how ironic is it that they attack the basis of their own freedom.

I am delighted to confirm that according to the article the remarks:  "produced an instant torrent of anger from lawyers, legal ethics specialists and bar association officials, who said Friday that his comments were repellent and displayed an ignorance of the duties of lawyers to represent people in legal trouble."

Furthermore, "Karen J. Mathis, a Denver lawyer who is president of the American Bar Association, said: “Lawyers represent people in criminal cases to fulfill a core American value: the treatment of all people equally before the law. To impugn those who are doing this critical work — and doing it on a volunteer basis — is deeply offensive to members of the legal profession, and we hope to all Americans.” "


Also, "Christopher Moore, a lawyer at the New York firm Cleary, Gottlieb, Steen & Hamilton who represented an Uzbeki detainee who has since been released, said: “We believe in the concept of justice and that every person is entitled to counsel. Any suggestion that our representation was anything other than a pro bono basis is untrue and unprofessional.” Mr. Moore said he had made four trips to Guantánamo and one to Albania at the firm’s expense, to see his client freed."



PUNCHLINE: 
I salute Karen Mathis, Christopher Moore and all those other lawyers and law firms who defend justice and liberty in spite of the vicious behaviour of the seriously misguided!  Bravo and keep it up!

Happy New Year from Anguilla!

Lawyers appreciate...

Lawyers appreciate good health, security and happiness – BUT WAIT, doesn’t everyone?  Yes.  That’s my point.  Lawyers are people and the vast majority of them are really good people.

Lawyers appreciate people who treat them with the dignity and respect. 

Lawyers appreciate people who recognize lawyer jokes for what they are – a form of bigotry (and who therefore pass on the opportunity to proliferate them).

Basically, I guess this means that lawyers appreciate the same things everybody else does - so whether you are a lawyer or not,  may you have the things you appreciate in abundance in 2007.

Bruce Marcus Fireside Chat



Yesterday my wife, Bethany, and I visited the wisdom of Bruce Marcus (and his brilliant wife, Mana) at their lovely Connecticut home - those bricks you see behind us are the Marcus fireplace so I guess you could describe it as a "fireside chat".  (He is the author of no less than 15 books, including his fabulous Clients at the Core.)

I was privileged to listen to some of Bruce's latest ideas about the legal profession.  For example, he believes that our profession is reaching a "tipping point" – if you follow either The Marcus Letter or his blog, The Marcus Perspective,  (I recommend both), you will soon be reading about his latest provocative thoughts.

Some consultants focus on the very practical but Bruce is more demanding for us – he is a visionary who knows what is possible and therefore has little patience for excessive compromise.

If you are not familiar with Bruce's offerings, check him out – I think you will be richly rewarded.

Seth Godin's post, Going to Meetings, outlines the benefits that might accrue to firms who look at their vendors in a new way. Here is how he introduces his wise tips for all who receive presentations from vendors:

Here are a few tips, tips that are based on one assumption: if you do a better job in the audience, the person speaking will do a better job. You'll learn more, get more, accomplish more, today and the next time she comes back as well.

Here's how he concludes:

When you treat your vendors the way you'd like your vendors treated, it comes back to you. It pays off. It gets you better information, better attention, better prices. You're a professional at your desk. You should be a professional at a meeting, too.

when he decided to create this email gem called The Effective Emailer. Guy recites a dozen sensible and perhaps essential rules of email etiquette.

I almost called this post: "Don't FUQ with me and I won't FUQ with you" but then I thought it may not be so obvious that this Kawasakism really means "Fabricate Unanswerable Questions". As for the title I chose, when you read #10 in his post you will learn how to avoid "a sure sign of bozosity"!

FASTFORWARD: Our Edge International project for a non-email protocol to dramatically reduce emaill within organizations continues. I think we're ahead of the curve (few people know they want this or care) which is exactly where we want to be. In the meantime, email behaviors neeed all the help they can get and I thing Guy Kawasaki's contribution is the best I've seen recently. Stay tuned.

Guy Kawasaki is quite extraordinary (click on his photo to see for yourself)... "evangelist, entrepreneur, investment banker, and venture capitalist" kind of sums it up but not quite.

In his post today, he discusses The Art of Schmoozing... his list is not only consistent with some of the best academic work I have seen on the subject but he describes his steps in such a compelling way, for example, his third step is:


Ask good questions, then shut up. The mark of a good conversationalist is not that you can talk a lot. The mark is that you can get others to talk a lot. Thus, good schmoozers are good listeners, not good talkers. Ask softball questions like, "What do you do?" "Where are you from?" "What brings you to this event?" Then listen. Ironically, you'll be remembered as an interesting person.

PUNCHLINE: Whether you are a Managing Partner or a CMO, share Guy Kawasaki's 9 step list with your law firm. You may have to translate it a bit (removing words that twist the stomach of most lawyers - like "tradeshows" - gosh, what would a lawyer do at a trade show, or MySpace - heaven forbid.) However the wisdom in this list is far too valuable to overlook.

During a recent retreat that my Edge International partner, Robert Millard, and I facilitated for her partnership at The Misty Hills Country Hotel outside of Johannesburg, South Africa, as part of a more comprehensive strategy process, we encouraged participants to describe specific actions that might move the firm closer to its objectives.

is in great demand but with everyone working so hard, predictable challenges arise. This is further exacerbated by greater regulation and more rigorous processes in the accounting profession. The bottom line is a palpable strain on the firm's most precious resource, its people.

Partner Mandi Fleiser suggested that all the firm's personnel needed an upbeat frequent reminder of what they could be "proud of" and "pleased about" and she conceived Mandi's Monday Memo, the first installment of which I am honoured to replicate here (with permission).

Legal Processes Destroy Leaders - Maybe That is Why It Is So Hard to Lead a Law Firm

The techniques managers use to get through a tough agenda in a business context are completely useless in a deposition. To survive the deposition, managers are trained to avoid the tactics they would have used in a business situation. Those who lead law firms are often experiencing more of a deposition environment than a business environment. Perhaps this is why some lawyers want their firms to be more "corporate".

This insight arises from the analysis of Wall Street Journal writer, George Anders, in his July 26 article called Depositions Require A Skill Set Leaders Don't Use on the Job (subscription required) in the July 26 WSJ (page A17 if you haven't thrown out your hard copy yet). Anders nicely illuminates the contrast between the very different business and deposition contexts.

FASTFORWARD: Those who live in law firms know what I mean when I say that the law firm environment resembles a deposition more than it does a corporation. A partnership meeting can be as grueling as a deposition. Support professionals (like marketing directors) often feel devoured by the environment. I believe that the lawyers training, especially litigators, fosters the propensity to lawyer their way through meetings making the leader's job next to impossible.

Lawyers must be highly critical and analytical when creating or improving documents or winding their way through the strategy of litigation. These are essential behaviors for lawyering but lousy for managing or being managed. Therefore, unless attorneys become aware of their propensities, they will bring this mode of behavior into all they do, including how they react to management, whether firm-wide or at the practice-group, industry-group or client-team level. Support professionals like Chief Marketing Officers walk away from encounters bewildered and frustrated by these strange (to them) lawyering behaviors that people outside the profession rarely exhibit (especially in corporate settings).

PUNCHLINE: Leadership requires "followership" which means that the more an internal meeting resembles a deposition ("examination for discovery" in many jurisdictions) the less productive the business meeting will be.

GOODNEWS: I have found that lawyers who are briefed about these anti-business behavioral propensities can easily transcend them. Once they are aware of them, groups self-police those who mistake the management meeting for a deposition; the noticeable increase in progress achieved is the immediate and reinforcing reward.

Holland & Hart Lawyers are Heroes

Holland & Hart lawyers meet the dictionary definition of heroes: "A person noted for feats of courage or nobility of purpose, especially one who has risked or sacrificedĀ…"

They are in good company. Allow me to excerpt my earlier post on another legal hero, second US President John Adams:

images-2.jpg"Mr. Adams added honor to the profession by taking on the most extremely unpopular trial of his time - defending British soldiers in the Boston Massacre in the Fall of 1770."

I do not think I need to tell you that President Adams would do precisely what Holland & Hart is doing and would say so in no uncertain terms. I hope this President Adams story will encourage Holland & Hart as it faces those who would criticize their initiative. (My full post Law's Heroes)

The U.S. Supreme Court made a ruling that suggests that detainees at the military prison at Guantanamo Bay have certain rights. The easy thing to do would be to look the other way or let someone else worry about such things. After all, there are many who will not be sensitive to the fact that love of country and constitutions means complying with the judgments of the US Supreme Court, not disobeying them. (If you require authority for this proposition, see this commentary on the case of Rasul v. Bush.)


ACF8E.jpgAnne Castle, former Holland and Hart Chairman, and Water Law specialist, sought volunteers for a pro bono initiative throughout the 12 offices of the 300+ lawyer firm sprawling over six states. I don't know how her invitation read, but this initiative clearly has absolutely nothing to do with the innocence or guilt of the prisoners. It has everything to do with ensuring they have the benefit of due process because the US Supreme Court decided they were entitled. Anne's request for volunteers was itself a heroic act.

Triplett "Trip" Mackintosh, the objective for volunteering is "Ā…seeing that the application of these laws is done fairly and in a non-discriminatory fashion". Tripp is one of the team leaders and an interview subject for the press on this issue. His specialties include the firm's newly featured Space Law practice group.

What a delicious offer (seeking volunteers): sign up for the most politically sensitive matter in present history and get ready for the hate mail and anti-American accusations. Risk your relationships with existing and prospective clients Ā— have the courage to risk like John Adams did. Many less courageous lawyers would sit silently. Not at Holland & Hart. The firm has exhibited a unique spirit over many years winning awards for client service and paying tribute to its own senior people at its retreats. This firm has a soul.

M_Beese.jpgNot one or two but thirty-three wonderful lawyers at Holland & Hart volunteered to do the right thing. According to Holland & Hart marketing director, Mark Beese, the volunteers came from across the political spectrum ("red and blue") and across most of the firm's offices, including a former JAG counsel. So this was not at all political Ā— it was about preserving constitutional rights in accordance with the ruling of the highest court in the USA.

The entire firm supports this new initiative and that makes every single member of the firm a hero in my book. They share the risk of negative feedback they are already receiving from some. They also underwrite the financial cost of the pro bono effort as well as sacrifice potential lost revenue from legal work that may not come or clients who might leave.

But, undaunted and courageous, like John Adams, these 33 volunteers in five teams press on through this most difficult process.

Background: Some readers may not be familiar with the term "Habeas Corpus" which, in essence, is the proceeding that can be brought before a court if someone is imprisoned without being charged in order to force the authorities either to show why the imprisonment is warranted or to release that prisoner. If you want a more formal definition, look at Habeas Corpus The Most Extraordinary Writ, by: Joseph Dale Robertson. (Incidentally, Robertson confirms that: "The history of Habeas Corpus is ancient. It appears to be predominately of Anglo-Saxon common law origin. Clearly, it precedes Magna Carta in 1215".)

Fast Forward: Those amazing lawyers at Holland & Hart are not alone - there are other good firms who have stepped up to batĀ… what is important here is that so many have not for the simple reason that standing up for this task comes at a price. It could annoy clients both existing and prospective. It would not exactly ingratiate you with members of the current Federal Government. This could and probably will cost. And, that is why I am so proud to call these 33 lawyers at Holland & Hart (and the firm for supporting their efforts) "HEROES". They are not sacrificing for the freedom of Guantanamo inmates - but by ensuring the ruling of the Supreme Court is carried out fairly and without discrimination, Holland & Hart is protecting the Rule of Law and the freedom of all who are protected by such laws including most who are reading this.

Punchline: When you are next chatting with a Holland and Hart lawyer, balance the hate mail with a heart-felt "thank you". And next time you hear someone make a snide remark about the greed or bad conduct or even image of lawyers, ask them to take a moment and thank their stars that there are lawyers like those at Holland & Hart around.

FAST FORWARD: I can not think of a law firm that would not benefit from Brian's formula and Brian is the kind or personally generous individual and lover of marketing to spend a few minutes with you and walk you through the process.

PUNCHLINE: As the sign in my doctor's office reads: "Well Done is far more important than Well Said". And that's why this post congratulates Brian with a "Well Done!" Can you get past the debates in your firm to achieve action like Brian did?

Law Firms Help Homeless Coalition

Congratulations to Atchley, Russell, Waldrop and Hlavinka LLP; Mercy, Carter and Tidwell LLP; Nix, Patterson and Roach; Patton, Roberts, McWilliams and Capshaw LLP; Patton, Tidwell and Schroeder LLP; and Young, Pickett and Lee who dug into their own pockets to fund an application that may see the Texarkana Homeless Coalition get as much as $300,000.

This is another example of a few lawyers just quietly getting on with social responsibility adding to the esteem in which our profession is held. They deserve thanks from every lawyer for contrasting the usual negative lawyer stories.

Here'a a quote from the Texarcana Gazette Article:

The Coalition received some invaluable help from local lawyers. The reason the law firms came together to support the Homeless Coalition is simple.


"We felt like it was a very worthwhile cause," said local attorney Kelly Tidwell. "It's a great plan and it's worth trying to have this grant put together."

PUNCHLINE: I just love catching lawyers doing the right thing.

"Commitment and Doubt"

Commitment does not require the absence of doubt; often commitment means acting despite your doubt.

FAST FORWARD: I believe this insight can be extremely powerful in managing law firms, or any professional service firms for that matter. Bright people are constantly analyzing because that is what they do to perform their work. As a result, they always see "the other side". No firm initiative can be free from second guessing. Therefore when we ask for a commitment, we either get a feint-hearted one or some level of resistance (from individuals who believe the initiative is flawed.)

I believe Larry's sentence is the mantra for amazing firmsĀ…because there, the troops understand that leadership requires their commitment notwithstanding doubt. For many firms this is a shift in mindset from , "I'll do it only if I personally have a profound belief in the initiative," to "I will trust my leaders enough to follow through on committments even if they might be flawed.

PUNCHLINE: This doesn't mean that we can't strenuously argue with leaders as plans are formulated Ā— it means, once the decision is made by a properly constituted leadership team, we will follow through notwithstanding our doubt.

Fortune calls him the Ur-guru (guru of gurus) of management, while the Economist tags him the Uber-guru. Business Week describes him as business' "best friend and worst nightmare." Tom, meanwhile, describes himself as "a prince of disorder, champion of bold failures, maestro of zest, professional loudmouth, corporate cheerleader, lover of markets and capitalist pig."

Apologies to those in the legal profession who are also business graduates and cannot comprehend the possibility that there is any literate person who is not already familiar with Tom's work. The sad truth is that far too many in the legal profession are not Ā— to their detriment, in my view. While law is first a profession and second a business, in order for a larger firm to thrive it is going to have to maintain its stellar ethical base but then compete as a business with zest and imagination.

Note the reference in his bio to the effect that "he has remained at the forefront of the movement to radically change organisations and how they are led in the face of new consumer, global and technological realities". The major law firms (as well as the not-so-major) are facing the same challenges as business Ā— after all, they serve business. I believe competitive advantage belongs to those who listen to Tom, think about what he is saying, and then creatively apply his ideas where appropriate and with courage.

By the way, I am delighted to see that the content from his book Re-Imagine! has been used to create four small-format books: Leadership, Talent, Design, and Trends. They're called the Essentials Series. Trusting Tom's marketing savvy, this will get the message to a lot more people (including, I suggest, those in the legal profession for whom the larger tome seems like too big a distraction from the "billable hour").

Andersen's Vindication - Too Little - Too Late

Andersen was the best of the best - training, growth, strategy - they were the role model - and then the scapegoat hunt happened in that great country with the best constitution in the world... that country that threw tea in the harbor... the country where people are innocent until proven guilty... that country stepped on them as if they were ants... tinier ants than they really were... and now, like the rapists DNA - they are exonerated - SHAME ON THE ZEALOTS WHO CRUSHED THEM

Proud Canadian again - This post is a "gamble".

OK - now it's getting funny (whew). See post below that horrified even me (about P.E.I., a Canadian province, reducing its suicide line from 24 hours to 9AM to 5PM - RIDICULOUS).

In reversing the cut, P.E.I. Health Minister Chester Gillan said his department was responding to concerns expressed by Islanders. He also said the province would consider expanding the service to help people with gambling problems. (I am not making this up - please have a glance.)

Good grief... we go from abandoning suicidal people for the 16 hours every day when they are most likley to need help to tossing gamblers into the 24 hour system.

I think I will stop reading Canadian news for a couple of days. I can't take the excitement.

(Thank goodness the earlier decision was reversed - Oh Canada)

I am a proud Canadian, EXCEPT...

An extremely embarrassing moment for every Canadian:

TORONTO (Reuters) - A Canadian province will shut its 24-hour suicide hotline and replace it with one that operates only during business hours. Prince Edward Island, a small province on Canada's East Coast, says it is too expensive to operate the hotline around the clock. Starting June 1, it will be open only between 9 a.m. and 5 p.m., Monday through Friday.

I post this with trepidation - take a look.

If this were not shocking - it would be funny... but it is not funny at all.

What would you expect from Cravath other than their 39 year old entrant, Faiza Saeed, boasting Mergers and acquisitions in the "billions" with a "B".

When it comes to handling transactions, don't talk to Faiza Saeed in millions of dollars, or even billions. Talk in hundreds of billions.
Saeed has been with New York-based Cravath since graduating from Harvard Law School in 1991, first as a summer associate, then working her way up to equity partner.

Did you notice the "her" in that quote? I hope so. Bravo Faiza!

The Massacre of Frank Sinatra's Reputation

Count out 70,000 of your crispest $50 bills for me - I need you to have $3.5 million in cash ready by the time you finish reading this so you will know first hand how big a briefcase you'd need and how heavy that briefcase would be... so you'll know whether you could sneak it through customs for one of your best buddies. You would do that for a buddy, wouldn't you?

Exhibit Two: a very famous deceased man, may he rest in peace - helps if he was the best male singer in the 20th century - yup, Frank Sinatra, Chairman of the Board, Old Blue Eyes himself

Exhibit Three: an unauthorized biography by two individuals, namely Anthony Summers and Robbyn Swan - now given how much bigger Summer's name is on the cover, below, I checked him out - he likes writing about dead people who can't fight back - check his previous titles:

The File on the Tsar, on the fate of the Romanovs;
Conspiracy, on the assassination of President Kennedy;
Official and Confidential, on J. Edgar Hoover;
The Arrogance of Power, on Richard Nixon;
Goddess : and The Secret Lives of Marilyn Monroe.

By the way, it helps that the Sinatra unauthorized biography isn't available yet - otherwise we could actually examine it (it will be available May 16th),

Exhibit Four: a generous helping of hearsay evidence from one of the funniest men of the 20th century (namely Jerry Lewis). Reuters: reports that: "According to Vanity Fair, the authors do not claim that Lewis witnessed the customs incident but rather related the account "as a fact of which he had knowledge." But alas, we understand Jerry's motivation - he finished his own biography at his own web site with these words:

"I shall pass through this world but once. Any good, therefore, that I can do or any kindness that I can show to any human being, let me do it now. Let me not defer nor neglect it, for I shall not pass this way again!"
Well, Jerry, you have a strange way of manifesting this philosophy of yours.

So gather up your exhibits and judge for yourself. Here's my take on this. I have no idea what the veracity of the about-to-be-published unauthorized biography is. Here's my point - neither does the press. Yet the press is arrogant enough and greedy enough to smear one of the greatest legends of all time with a preposterous and implausible story based on hearsay evidence that no court would accept. Why? Because someone sent them a press release? How is that responsible.

OK, now I will confess where I got the idea of how improbable having 70,000 bills in a briefcase is - In the CNN.com publication of Reuter's story, The CNN Editor credits CNN.com readers with the basis for pointing out how ridiculous this story is. The CNN Editor does not pull the story, but slips these words in parentheses at the end:

(Editor's note: Several CNN.com readers have pointed out that Sinatra's briefcase would not only have to have been very large -- $3.5 million is 70,000 bills -- but would weigh about 150 pounds. CNN.com spoke to the publisher, who confirmed the Lewis quotation is accurate.)

(Yeah - the Lewis hearsay quotation is accurate.)

So the CNN.com Editor is suspicious enough to include the paranthetical remarks but still floats the story... why?

I wonder where Mr. Lewis' knowledge came from. From the same place as his knowledge that skinny Mr. Sinatra (as he then was) could carry the world's largest and heaviest briefcase through customs, risking his fame, wealth and liberty for his questionable buddies. Oh and the authorities were so inept, that having opened this briefcase, and with $3.5 Million in front of them, Sinatra's adoring fans were just too distracting to allow them to notice the 70,000 bills. Great story, Jerry. Great knowledge.

Would someone out there please join me in telling Reuters, CNN and others who repeat this story that not everyone who looks at the news is inert enough to simply accept whatever tripe is loaded onto our screens... SHAME on Reuters and everyone who picked up the story for victimizing the defenseless deceased on such a shallow foundation - ask yourself one simple question - if Sinatra were alive, how big would his punitive damage award ultimately be.

What has this to do with this blog, "Amazing Firms, Amazing Practices,"? Not much but I am a Sinatra fan and choose not to sit idly by while the lazy press participates in the postumous execution of his reputation. If there were the fragrance of proof, I would like to see it. I am afraid the knowledge of Jerry Lewis who heard about this second hand is way too little... and the press should be embarrassed to base a story on it.
